Hotel Fit-Out and Renovation Approval in Dubai

Decree 17 of 2013Prior Written ApprovalMajor RepairsFacilitiesFines

Hotels carry an approval layer other buildings do not. Decree No. (17) of 2013 bars any government entity from issuing a permit to build or convert a hotel without the tourism regulator's prior written approval, and existing hotels must notify it before major repairs.

Hotel projects in Dubai sit under Decree No. (17) of 2013 as well as normal building approvals. Under Article 3, no hotel may be constructed and no existing building converted into one without the prior written approval of the DTCM, and no government entity may issue a permit for either without it. The decree names the Department of Tourism and Commerce Marketing. Tourism regulation now sits with Dubai's Department of Economy and Tourism (DET), so confirm the current contact and procedure with DET. We did not find a published DET fit-out procedure or fee schedule, which is why early contact matters.

Major Repairs and Facilities: The Clauses Operators Miss

Two obligations in the decree catch operating hotels:

  • Notify the regulator before commencing any major repairs
  • Do not add or close any facility without prior written approval

That second one is broader than it sounds. Closing a restaurant for conversion, or adding a spa, can fall under it even when the building permit is straightforward. "Major repairs" is not defined in the passage we reviewed, so take a cautious view and ask early.

02

Building, Fire and Utility Approvals

Beyond the tourism regulator, hotels follow the normal authority for the plot:

  • Dubai Municipality on the mainland, through BPS
  • DDA in its areas, where the Fit-Out Permit is AED 0.90 per ft² (minimum AED 200, maximum AED 10,000) and valid for 6 months, with a Civil Defence completion certificate needed before fit-out completion
  • Dubai Civil Defence for fire and life safety, usually the most demanding review in a live hotel
  • DEWA where loads change

Kitchens add food safety. See restaurant fit-out approval. Converting a use, such as offices into rooms, follows the change of use route.

03

Penalties

Article 12 sets fines from AED 100 to AED 100,000. A repeat of the same violation within one year doubles the fine, up to AED 500,000. The Chairman of the Executive Council determines the specific prohibited acts and fines, and the regulator may take further measures on top.

04

Renovating While Open

Working in a live hotel shapes the approvals as well as the build. Phasing floors, keeping escape routes and fire systems active, and managing noise all need to be resolved early. Civil Defence will want to know how life safety is maintained during the works, so phasing should be part of the submission, not an afterthought.

Frequently Asked Questions

01Do I need approval to renovate a hotel in Dubai?
Often yes. Decree No. (17) of 2013 requires hotels to notify the regulator before major repairs, and adding or closing a facility needs prior written approval. Structural, MEP or fire-related works also need a building authority permit.
02Can I convert a building into a hotel in Dubai?
Only with the tourism regulator's prior written approval. Under Article 3 no government entity may issue a permit to convert a building into a hotel without it.
03Is DTCM the same as DET?
The 2013 decree refers to the DTCM. Tourism regulation is now handled by Dubai's Department of Economy and Tourism, so confirm the current procedure with DET.
04What are the penalties under the Dubai hotel decree?
Article 12 sets fines from AED 100 to AED 100,000, doubled for a repeat within a year up to AED 500,000, and further measures may apply.
05Does a hotel room refresh need a permit?
A purely cosmetic refresh often needs no building permit, but check whether it counts as major repairs, and whether the scope touches fire, MEP or structure.
