Change of Use Approval in Dubai 2026: Every Route Compared

Office to F&BOffice to ClinicDMDDADIFCWhat It Triggers

Change of use is not a fit-out with a new sign. Each authority routes it differently: DDA moves it out of the fit-out permit into building modification, DIFC charges ten times the fit-out NOC fee, and fire and occupancy requirements are reassessed. Choosing the wrong route can cost you the fee.

Change of use means altering what a unit or building is approved to be used for, such as turning an office into a restaurant, clinic or nursery. It is treated as more than a fit-out because the new use can change occupancy, fire safety, parking, loading and services. The most useful fact for budgeting comes from DDA's Fit-Out Permit page: for adding structural elements, changing the use or adding GFA, you must apply for a Building Modification instead, and if DDA finds a fit-out submission should have been a modification, the fit-out fee is not refunded. Get the route right before you pay.

What a Change of Use Reopens

Expect reviewers to look again at everything the original approval assumed:

  • Occupancy and fire safety: a new use changes occupant load, exits and fire systems. See the civil defence approval guide.
  • Structure: floor loading differs between an office, a gym and a storage room.
  • Services: kitchens need extraction, grease management and gas; clinics need sanitary and ventilation upgrades.
  • Parking: demand changes with use. Administrative Resolution No. (227) of 2022 shows how specific such concessions are, allowing up to a 15% car park shortage only for a roof gym converted to residential or office use in buildings built after the resolution.

Sector Approvals That Come With It

The building approval is rarely enough. Common add-ons:

Secure the sector regulator's position before you sign a lease. A compliant fit-out in a unit the regulator will not accept is the most expensive outcome here.

03

Before You Sign the Lease

Four checks prevent most failures:

1. Confirm the permitted use on the affection plan and with the landlord

2. Confirm the building has a completion certificate. DDA's modification service is only available after one is issued

3. Ask the sector regulator whether the location is acceptable

4. Price the route, including fire upgrades, before committing

In DIFC, confirm the application type early, since the fee difference between a fit-out and a change of use is AED 28,350. See DIFC fit-out approval.

Frequently Asked Questions

01What is a change of use in Dubai?
It is an approved change to what a unit or building may be used for, such as office to restaurant or clinic. It goes beyond a fit-out because occupancy, fire safety, loading, services and parking may all need to be reassessed.
02Is a fit-out permit enough to change the use of a unit?
Not in DDA areas. DDA says changing the use requires a Building Modification request, and if a fit-out application should have been a modification, the fit-out fee is not refunded.
03How much does change of use cost in DIFC?
The DIFC NOC for change of use is AED 31,500 including VAT, compared with AED 3,150 for a building fit-out application. DDA and Civil Defence costs are separate.
04Does change of use need Civil Defence approval?
Usually yes. A new use changes occupant load and fire risk, so fire and life-safety design is normally reassessed.
05Can I convert an office to a restaurant in Dubai?
Often yes, but it depends on the permitted use, the landlord, extraction routes and food safety requirements. Check these before you sign a lease, since extraction is commonly the deciding constraint.
06Who submits a change of use application?
On the mainland, a registered consultant through BPS. In DDA areas the contractor is the listed requester for the modification permit, with drawings prepared by the consultant.
