Dubai Villa Extension Rules 2026: What Home First Actually Changed
Dubai Municipality's Home First initiative relaxed villa rules: setbacks down to 1.5 m, second floors across 100% of the floor below, and annexes up to 8 m high. The catch is eligibility. The reforms were announced for Emirati families, and developer rules can still be stricter. This guide separates what is agreed from what is not.

Figures below follow the October 2026 report, the most detailed we found, cross-checked against the 2025 coverage.
| Element | What is reported | Conditions reported |
|---|---|---|
| Villa setback | 1.5 m on all sides | Stated for Emirati owners |
| Removing a setback | Possible along shared boundaries or access lanes | Written consent from the affected neighbour |
| Second floor | Up to 100% of the floor below | Natural light for habitable rooms per the Dubai Building Code |
| Family annex | Up to 8 m, at least two bedrooms and a living room | No windows overlooking adjacent plots or lanes |
| Service annex | Ground plus one floor, up to 8 m | Max 30% of road-facing boundary; not before the main villa is complete |
| Second villa | For first-degree relatives or specific social needs | Signed undertaking; beneficiary aged 18 or over |
Does Home First Apply to Non-Emirati Villa Owners?
This is the question most articles skip. The reports do not agree on how far the rules reach:
- The October 2026 report states the 1.5 m setback for Emirati property owners.
- One 2025 report describes the 1.5 m minimum without limiting it in the body, while framing the package around Emirati families.
- Another 2025 report's FAQ says Emirati families are eligible.
- One design firm says the rules apply "primarily" to Emiratis, and that other owners must follow community and municipal rules.
Our reading: a non-Emirati owner should not design around Home First until the setback is confirmed for that plot in writing. Your consultant can test this with Dubai Municipality before any design money is spent.
Service Annex Layouts: The Three Options
The two-storey service annex has the most detailed rules, and reports disagree on them. The October 2026 report gives three layouts for a two-storey annex:
- No setback from the neighbour, but a 1.5 m separation from the main villa
- Adjoining the villa, provided the neighbour setback is kept
- A 1.5 m neighbour setback, with no gap to the villa
A single-storey annex may sit on the boundary. A two-storey annex is prohibited if the main villa is ground floor only. Earlier reports simply say the setback between annex and villa was removed, which is less precise. Treat the October detail as the working position and confirm it.
Where Reports Conflict, and What to Do About It
Three more gaps matter when you budget a design:
- Rooftop floors: one report says an "additional" 1.5 m setback applies, others just say rooftop floors follow a 1.5 m rule. The difference changes usable roof area.
- Plot coverage: none of the reports we read gives a coverage ratio, so coverage still comes from your affection plan.
- Dates: the October 2026 article calls the rules revised but does not say whether it reports a new revision or the 2025 package.
Pull the affection plan first, then have the consultant confirm the rule set before concept design.
Community Rules Still Apply
Citywide relaxation does not override a master developer. In Emaar, Nakheel, DAMAC or Dubai Holding communities, the developer NOC is still step one, and design guidelines and GFA fees can restrict what the municipality would otherwise allow.
